Was Your DUI Case Dismissed? Get Answers To The Questions You May Have

Celina Henry

A great DUI attorney may be able to help you get the DUI charges you are facing dismissed. There are different defenses that can be used to help make this happen. If the charges against you were dismissed, you may have many questions about the DUI and the dismissal. Here are a few of the most commonly asked questions that you may have after your driving under the influence case was dismissed.

Can DUI Charges Be Refiled?

When your DUI case is dismissed, it will either be dismissed with prejudice or without prejudice. If your DUI case is dismissed with prejudice, the case is over and no charges related to the DUI arrest can be filed against you in the future. If your DUI case is dismissed without prejudice, charges can be refiled. DUI cases are often dismissed without prejudice if key witnesses or pieces of evidence cannot be located and later, they can be located.

Will the DUI Show On Your Driving Record?

A DUI will not show up on your driving record until you have been convicted of a DUI. As such, a DUI will not show up on your driving record ever if you have been found not guilty of the DUI, had the charges reduced or got the DUI case dismissed. However, in some states your license may be suspended immediately if you are charged with a DUI. If you live in one of these states, and your license is suspended, the courts will give you a print-out to take to your local department of motor vehicles and get your licensed reinstated if charges against you are dismissed.

Can You Get Any Money Spent Back?

If you were charged with a DUI, you may have already incurred expenses as a result of the charges. Your car may have been impounded and you may have paid impound fees or you may have bailed out of jail. Unfortunately, you are unable to recoup any of this money if the charges against you are dismissed.

If you have been charged with a DUI, it is important that you consult with a DUI attorney. A DUI is not a traffic infraction; it is a criminal offense. You can have your drivers license suspended, face higher insurance rates, have to pay hefty fines, be unable to secure certain jobs in the future or even be unable to pass a background check for a rental home. A DUI attorney can work to get the charges against you reduced or dismissed so that these charges do not haunt you for the rest of your life.
